Federal Tort Claims Act + Strict Requirements of the Law
The Federal Tort Claims Act allows a limited exception for individuals to sue the United States Government. However, as my law school professor once stated: “The Federal Courts seeks to slam the door in Plaintiff’s faces.” In other words, the federal courts are always looking for ways to turn people who have been harmed by the government out of court.
In the Courthouse News story (full article found here), farmers were left with no recourse for the clear damage caused by the Government’s actions because their case was filed A SINGLE DAY LATE!
