Surgical Accidents and Mishaps

When we undergo surgery, we place our very lives in the hands of doctors, nurses, and other medical professionals. We assume that they have the training and experience necessary to conduct a safe surgery. Unfortunately, surgeries do not always go well.

There are a variety of ways in which a surgical accident or mishap may occur. These ways can range from extremely egregious cases of operating on the wrong body part or leaving a foreign object inside the patient, to mishaps such as the following:

  • Inadvertently harming the patient through cutting a critical blood vessel, which can cause damage such as depriving the brain of oxygen,
  • Not properly administering anesthesia,
  • Not properly administering other drugs,
  • Failing to diagnose internal bleeding prior to finishing a surgery, or
  • Otherwise not performing the surgery in accordance with medical standards.

When Surgical Accidents and Mishaps Occur, We Fight Back for Our Clients

If you or a family member has been injured as a result of a surgical accident or mishap, please contact us. Firm founder Jim Dore has decades of personal injury experience in representing the injured, including cases of medical malpractice.  Our attorneys have been successful in obtain favorable results for numerous clients.

What Must Be Proven in a Case of Surgical Accident or Mishap?

In the case of a surgical accident or mishap, as your legal counsel we must first obtain all the records possible concerning your surgery. Once we have this information, we can then hire a doctor, nurse, or other medical expert if necessary to review these records carefully to determine whether the appropriate standards of medical care were met.  If the standards were not met, a lawsuit for medical negligence or malpractice concerning your surgery may be appropriate.

If this is the case, in order to recover compensation, we must prove the damages that were suffered as the result of the surgical accident or mishap. These damages often include additional unnecessary surgery, such as in the failure to stop internal bleeding prior to finishing the original surgery.
